Pavan, Ajay, they started giving the EAC numbers already. But being patient is something you can do at this moment.

@ KM, probably he thought Plan B is something like an official plan from US immigration.
@ Narahari, Congratulations for getting through the lottery. Yes, they do send receipt number and you can check the application status on USCIS website with that EAC number

Hello guys, I have a news for you on H1B 2009 processing cycles.

With my contacts and friends who are going through this process, some of the consultants and companies, I came to know that USCIS has processed the lottery and initial approval process for PREMIUM application as of now.

The regular applications will receive their status and EAC numbers in May or June month.

If I get more updates, I would comment in here. Please keep on visiting this page and this blog for more updates.

Folks,
Some employers doesn’t want to relieve the receipt numbers to ensure that everyone who got thru the lottery process get to know their status at the same time. This is to avoid confusion and mis-understanding. So, people need to wait till June 2nd.

@ kch, do you have any idea how many visas were applied through masters quota? Sorry I did not keep track of that. And yes, until you or your employet get rejection mail from USCIS, you certainly have a chance for visa

@ kanwar, check withdrawal and the receit number receiving date might not have distinct difference in days. If you gets through lottery, check will be retained by them or returned if not

@ grarun24, yes there was similar thing but not exactly wait list last time. Let me explain quickly. Last year they had selected 65000 application through lottery but they did not which are eligible to be approved so they had selected 20000 more for backup. The people who were not in first 65000, but in next 20000 were kind of in waiting list. So any application rejected from 65000, would allow to select that many from next list of 20000. I am not sure if they have it this time.

@ jrbd, NO - that does not mean rest of the applications are rejected. Whoever has been selected in the lottery should get the details one by one, keep your fingers crossed and keep on visiting us to get updates as and when we receive.

@ chaitanya, congratulations on getting through the lottery. Let us know here once you get the EAC #.

@ Kanwar, regardless of your application approval, the check / cash is withdrawn from everyone. If your application is rejected [which I don't want to see], you will get your refund from USCIS

@ Jaanvi, that’s perfectly fine. Though I feel day should be of more than 24 hrs, I deal with the shorter days to work but still try to help out going beyond the extra mile for my readers, commentators and friends. I will get in touch with you.
@ nimmi, I appreciate your compliment. The lottery system works like this -
The application received through FedEx to USCIS office are given numbers and These numbers are fed to the computer program to select any random 65000 numbers. It’s as simple as that. This system has started last year when USCIS saw loads of application on 1st day. They decided to go for lottery as it was difficult to figure out what application received first on 1st april on the same day. Due to the expected demand for H1 this year, they had given first 5 working days for applicants and lottery will be applicable to all those applications received in first five working days.

Finally, Let me share a good news with you that I wanted to, since so many days! My application has been already through the lottery and it has been approved. It was a premium application processing.

After checking EAC at USCIS website, it shows - Current Status: Case approved;

So provided I get through the visa interview, I safely assume I will land up in the States in coming Oct/Nov. see you all who would have their H1 approved in the States soon [if you would like to :)]

Folks the best way to know if your application is selected in lottery is to find out whether the checks/money has been drawn out from your company’s account. The money is only drawn after the application has been selected in the lottery. it might take a while to get your receipt notice. So ask your companies attorney if the check has been drawn by Homeland Security…Good Luck.

Oh my God, there are so many messages again today. But I should answer to each of one of you here. No problem as such, let me take one by one.

@ Kanwar, I think I have little different opinion here. Last year, USCIS had withdrawn money from my employer’s account and as my application could not go through lottery last year - USCIS had returned the money. Thinking this as real case, I don’t think we can guarantee approval after withdrawal of money

Let me explain my case once again briefly,
I received info from my employer on 28th April that my file has been selected.

Then i ask him to give me my Application receipt number. So he provide me my receipt number which is WAC********** (13 digit no.).

Is it what u say EAC number?

Using this number i went to USCIS site and check my status. which displays in the status field “Case received and pending”.

Does it mean that my case has been selected in lottery system but yet not approved? if yes then how much time it will take to be approved?

Please brief me about that.

What is master Quota ? My employer also told me to wait till not even june 2nd but june end. even if the visa are approved and if by bad luch they come in the end of July. Here is my question. If they didn’t choose my application by lottery, are they give me back my premium processing fee($1000)?

Hi All,

I received a Receipt Notice which is I797C Notice of Action for CASE TYPE I129 Petition for a Non Imigrant Worker (that what it says)from my Employer.
It contains Receipt number starting with EAC. My belive is this is the Application Receipt Number which you fed in the USCIS site.

Now is the following understanding right when a candidate received this Notice from USCIS ?

1) That is this Application is through with the Lottery system and The Status for this application when checked in USCIS site is “Case received and pending” is that means the USCIS is srutinising the application for completeness after it gets picked up from the Lottery.

Is this is the starting point of any petition for H1B approval subsequently for which you need to attend the interview at the consulate when approved.

Hope to hear a clear explanation from somebody.

Your past one month waiting should be taken as a piece of cake. According to the California Service Center, those cases which failed to make it in the lottery will not be mailed out until June 5, 2008. Hi All, For Those people who are waitng for the receipt number, I would suggest to wait until June 2nd. “Pay GOD every DAY and do good to all being around You for their blessings”. USCIS says that they need time to get all employer notified about their receipt status. Until then WISH U ALL THE BEST. If you have heared from you employer about receipt number through mail, then I would say they should have shared with you I797C Notice of Action a one page document send by USCIS to your employer. They (employer) would have received information from USCIS on your application like how they would be processing your case. The time each service center take to process is different. and starting three letters of your receipt number such as starting with (EAC, WAC, LIN, or SRC)determines the service center where your employer has filed your application and has got their receipt from. Format is like e.g. EAC-XX-XXX-XXXXX. Now all those who received the receipt number can ask your employer to share the I797C notice of action. If you receive this from your employer that means you have been picked up in the Lottery. Now when you check the status at this site of USCIS https://egov.uscis.gov/cris/caseStatusSearch.do by removing the hypen in above said receipt number format then you would able to know the status of your application. Now if the status is “Case Received and Pending” then that means USCIS is in the process for approval by sructinising your application as per the H1B processing rules. That means checking the employer and the job for which you have been picking you for and your complete credebility check. So to get the status for such case usually takes around 2 months. So we need to wait that longer and in most cases gets through to the Approval stages and if you are lucky enough you may know earlier as well. Disclaimer: this information is purly based on the experience and opinions of my friends who filed H1B earlier and who has gone through this process including myself.

My lawyers tell me that they allready received almost every acceptance and that they are almost a 100% sure that they haven’t received any news from me because my case was rejected.
My question is: if I applied under premium processing by today I should have an answer either bad or good, right?
Well, I still have hope.

There is nothing wrong in filing multiple petitions and that does not grab any others opportunity as the USCIS counts duplicate applications for a same employee filed through different companies, as a single case. For examples, Kamal filed through two companies and it would be counted against the cap 65000 as one if both the applications get selected. So on one is grabbing others opportunities. Be koool.

@simran - employers get to know that an application is picked up when the cheque that is submitted to USCIS (on your behalf) gets enchased. But, it takes sometime for USCIS to send the recepit# to your employer. So, Congratulations!! & bear with your employer until he provides you with the receipt #. All the very best for your visa.

Some companies, just to make to stay till November will say “Your H1 visa has been selected” and then when November comes, they will say “Your H1 has been rejected”. That is a tactic played by many companies including the top 5.

When the check gets encashed, employer finds out that the application is been selected in the lottery.
However then they will wait for the official receipt notice from USCIS, which will take sometime.
Even my employer confirmed to me that my appln has got selected as the check is been encashed, but have to wait for the receipt notice.

So, the best choice would be to demand for the recepit after June-2(if not provided by then), thts the tentative date as of now, by which all lottery “winners” will be intimated of their receipt #s officially.

I have to admit here that the interim rule on duplicate petition, is bit confusing. If you read the USCIS link [USCIS will now either deny or revoke multiple petitions filed by an employer for the same H-1B worker. ] it’s very clear that if an employer files more than one petition for the same employee is considered as duplicates. For example, the company XYZ files more than one petition on behalf of you considered to be marked as duplicates. There is one point in the interim rule that backs the above statement which is “The rule does not prevent related employers (such as a parent company and its subsidiary) from filing petitions on behalf of the same alien for different positions, based on legitimate business need.”. I guess, if you read both the rules, it makes sense that petitions filed by different employers for the same person, is not duplicates. Again, this may not be correct as the rules never explicitly states the above.

Guys ! as an beneficiary I am also not selected or no news from my employer but he tried to suad me as under.

There were 163000 applications.
let 50000 be Premium filers, and rest Regular and from Singapore and China or rest of the world’s regular filers.

Premium Filers were in the bracket of 14 - 39 april time. Can you imagine how much load would it be on the people in USCIS. Plus it will definately take time for them to intimate Attorneys and companies. We assume AMERICA bein super power and can deliver the result as fast as SPIDERMAN speed is not the real. The fact of the matter is they dont have enough men power to handle the mountain of files. One can expect some computer network problems, computer hangups , blue screen ( no no that must not happen ) , and people not show up on time for their jobs. So many things.

I travel to USA like few times a year. I have seen how things work in USA government agencies as well private sectors. They are well-equiped , smart people but at the same time they are Humans.

So as per my employer, dont think too much as well as dont speculate things which actually do not exist.

I think by July End the picture will be cristal clear.

I think waiting till the second week of June would be a very sensible thing to do, instead of going into false assumptions and unnecessarily spoiling your health. Even after that if your legitimate employer/consultant has not intimated you, then you may start thinking about other career improvement plans, or wait till next year for H1.

Im still waiting for a good news of my application as of today. Its a very stressfull event but Im still keeping my faith and believing Ill have my petition approved. Guys, for all those people who have applied through job consultants, wait till June 2nd. If you still have not got the results, either cleared/on hold, you are doomed. For those working in IT companies such as CTS, Wipro, Infy, TCS etc, the companies will give you the visa in the 2nd week of June. These companies do it, because they want to let the managers of those resources who applied for H1, to reduce the dependency on those resources who have not got selected (as they may put their papers immediately after hearing the news).

folks… perseverance always pays off.. I just heard the gud news from my employer. Have faith & the rest follows..
@ sony - mere selection in the lottery & getting a receipt # doesn’t mean a H1. It surely is the first step and the real struggle starts only after that..it generally takes a week’s time (max) to get the recepit, once the cheque gets enchased.
@ Jaanvi - I don’t think a great deal of documentation goes in, when the app gets picked up initially. USCIS will be keen in seeing the docs, when you appear for the visa interview at the consulate. Also, when companies prepare an app for H1, I don’t think they will be sloppy in preparing one.

@ Jaanvi, @idlebrain, if the documents are fault, they would take some time to revise them. One of my friend’s case is pending due to the documents. In this case, they just keep an hold on the application, don’t reject it.

@ nimmithomas, if the consultant has received the email confirmation, that should be fine. The documents are being sent by courier and would be reaching your consultant in 2-3 weeks since date posted.

@ Girlicious, Idlebrain seems to have received his confirmation. No one has the H1 got approved completely until they get the stamping done in VISA office in India

@ Guys don’t worry a lot about it, if it gonna happen it would happen or it would not.

I think little confusion in word from my side right. H1 approval will be given now by USCIS. But the “complete process” as I think what is “meant” Girlicious, finishes when you get H1 visa stamped by US embassy after you take your approval documents in VISA interview.

Now when someone has this EAC number, they would have to take a BAR code from bank [mostly HDFC in all areas of India, atleast Mumbai] and take that receipt of Visa interview fees on the interview date. There is a possibility that the H1 visa interview can fail, isn’t it! If you pass that interview which is 99% possibility, I believe your complete process gets over.

My employer says Case Received and Pending cases will take 3 to 4 months for approval this may include you getting papers from your employer to attend VISA interview etc. Provided you paper work is done correctly by your employer or there is no past rejection cases or any fraud in the case.

Its a long process of wait and agony until you passport get stamped with H1B.

All the best for guys who have received receipt notice that means you are through with the random selection process ( lottery) and others can just wait for atmost for this week.

As was said repeatedly, but you still cant keep quiet. Wait till the end of second week of June guys. I know it is frustrating, but you gotta wait till the end of June 2nd week. That is when you will get your lottery results.

For the people whose visas are on hold. Let me tell you, start pursuing Plan B. There is a very meagre chance (less than 2%) that you might get selected.

About the folks who are thinking about L1 visa, yes you can apply, but not thru job consultants, either thru Wipro, Infy ~ The big 5. Your visa will get selected and you can travel for 3 years.

The other way maybe L1 if your employer is ready to process that for you.
I am in US on H4 and keeping my fingers crossed for this week ,else I”ll have to go back :(
No other options though many lawyers are suggesting H3 (training visa in US) but that is not suggestible.

Can anyone advise whether USCIS will inform an unsuccessful employer about applicant’s other sucessful application? Two employers had applied for me, and one who was very fair with me, has got reeipt no long back. Now the other one says his attorney is contacting USCIS, if my name is in system, will they inform the second employer that i have got receipt no through other company? Both of them are not related and it was a geniuine two diff jobs, but I do not want things to get complicated. Thanks for advise.

@Viky, Varu and Simran. In normal cases, pending would be the initial status if the petition has been selected in the lottery. The status will be changed into ‘Approval notice sent’ once the service centers scrutinized your documents, which are filed along with the petition. Once the status has been changed into Approval notice sent, you are all set to go for the visa stamping with the respective US consulates after fixing an appointment with them through VFS, but only after Oct 1st.

@Janvi - There are cap exempt work permit those are issued to cap exempt institutions like research centers, specialists in hospitals etc. But I don’t think this is applicable in your case. You can still go for a inter transfer visa (L1) visa through your present company. Of course you have to check with your manager for this option. Or for time being, till next April 1st, you can try for a job in Singapore or UK ( HSMP).

@Ganesh. I don’t think USCIS would reveal the details of someone else to somebody. Moreover H1-B is more specifically allotted to a company. So I feel, even if the attorney enquires, he gets the details of the petition that he filed. Not sure, but I feel this makes sense.

Varu, If you have heard from your employer that your application has been picked up in the lottery, you are safe. (if it is a genuine info) . The same thing happened with me as well. My employer called me up and told me that I’m through the lottery and I got the EAC # after a week. So, keep your fingers crossed and wait for the receipt number from your employer.

Congrats to all those who have been selected in the lottery.

One of my friend who had applied along with me had his status as ‘Approval Notice Sent’. He seems to be quite lucky that his application had been processed and the onsite consulting company had received his H1B papers.

U.S. Citizenship and Immigration Services conducted a computer-generated random lottery April 14 for 20,000 master’s cap exemption cases. A subsequent lottery for the remainder of advanced U.S. degree petitions—together with the general H-1B pool of petitions for the regular cap—has also been conducted.

USCIS announced last week it had received enough cap-subject H-1B petitions to meet the annual cap of 65,000 H-1B visas for fiscal year 2009. An additional 20,000 H-1B visas available under a cap exemption for individuals who obtain an advanced degree from a U.S. college or university was reached. In a preliminary count, the agency estimated nearly 163,000 H-1B petitions were received during the filing period. More than 31,200 of these petitions were for the advanced degree category, according to USCIS.

The 15-day premium processing period commenced April 14. Receipt notices for cases selected in the lottery for full adjudication and without a request for premium processing should be received by petitioners no later than June 2.

Even I am in the same boat, my employer informed me this week that my application has been picked up and they are waiting for the receipt number.

Does’nt makes much sense tough. I’ve got following two major concerns

1) How come my employee knows that my application has been picked up in the lottery. When the receipt number is still yet to arrive?

2) How long do I’ve to wait to get my receipt number? Pls note that today it is 5th of June

There is still hope, but small. The USCIS press release of April 14, says , petitions selected throw lottery will get recipt dated no later than june 2. So there will be some people who should get receipts thsi week and maybe next. So the will be teh last lot with receipt date of June. And there will be ones who will intimated tat they are in the waitlist. So keep your fingers crossed.

If you’ve received lottery confirmation but waiting for EAC# then there is a little hope for you.

“GAME IS OVER” for those who have not received anything yet but never mind you can re-apply next year.

What does that means?

Do not worry for receipt number.
For every cheque enchashed there will be a receipt number written at the back of the cheque.
If your employer can manage to get it from the bank ,u can know it .
But still you will any way know it… might be in 2 days or 25 days.But u are through the lottery.Do not think much guys.
have a party if u have planned for lottery success.

@Simran – Did you get your EAC #? You need to bother about the status only if you have your EAC# handy.

@Daxesh – Your employer must have missed any required document while filing the petition. USCIS sends an request to your employer asking for the document in this case. You don’t need to worry about this as long as your employer could send the requested document. Here are the statuses once your petition has been picked up in the lottery.
1. Status will be ’Case received and pending’ if picked up in the lottery and USCIS sent petition to the service center (eg: Vermont Service Center ).
2. Status will be ’Approval notice sent’ after service center finds all your required documents are in place and genuine.
3. Status will be Request for additional evidence sent if any required documents are missing while filing the petition.

And of course the time taken to get the status changed is first come first serve basis and as the service center processes it.

@Ganesh – You must be in the US in B1, F1 or any other visa. You have to follow the same steps to get the visa stamped as you did before.
I don’t think you can get the visa stamped from the US. You have to go for an interview with a US Consulate, which is outside the US.
Here are steps anyways,
1. Fix an appointment with the respective US consulate through VFS. In case if you are planning to get the visa stamped from India, you have to visit https://www.vfs-usa.co.in/Home.aspx
2. Attend the interview. You have to have all the documents along with you during the interview. There will be a check list of H1B interview in the site Or get it from your employer.
3. You have to surrender your passport with US Consulate to get the visa stamped on your passport if you are through the visa interview and they will courier the passport back to you within 2 weeks.
4. Now you are all done flying to the dream land. All the best.

Hi All ,

Here is jist of the story which will happen for H1B filing

Your employer will submit an envelope of all your documents along with a cheque to USICS.
Each envelope will be given a unique id i.e., EAC number by USICS.
They will now take a random pick of these numbers .
Once the number has been picked they will first encash the cheque from the respective envelope and then they will mail thE EAC# to the employer.
For records they write the EAC# at the back side of the cheque.

Once the cheque is being encashed they will do an educational validation based on the documents in th envelope followed by some formalities .

If every thing looks fine from there side that envelope will be sent to respective counsulate(chennai,Mumbai….)

So even if your petition has to rejected after your cheque is encashed ,u will be provided with EAc#.

After encashment of cheque all the rejections ,approvals , pendings……. will be wrt the EAC#

H1B Visa Lottery Results Updates
06.05.08 | No Comments

June 2 was the deadline set by USCIS to send all the receipt number to H1B Visa applications selected in the lottery. It was D-Day for many H1B Visa Applicants who are still waiting to hear about their H1B Visa Lottery result. But, so many comments in the articles in this blog say different story.

Majority of the applications filed under Premium Processing heard about their results
H1B Visa applications submitted in Regular processing results are not 100% available
Some of the check have been cleared, indicates their H1B applications have been selected in lottery
But, those checks that have been cashed by USCIS are yet to get the ReceiptNumber
No one has received any rejection notice so far.

From above view, I certainly feel, USCIS have not completed processing of all applications selected under Lottery. If they were to process all the applications that were selected in H1B Visa Lottery, then those applications should have received their Receipt Number. So, we have to wait for 2-3 more week to know whats the status of H1B lottery results. If I come across other information, I will pass it along.

I applied for H1B through my employer…I got receipt number which starts with WAC#######..when I checked the status in website its showing ” CASE RECEIVED AND PENDING”..I am confused about this…does it mean that I am through…and let me know what are the chances of getting visa now? I am confused…please clarify my doubts…

Nethier I am informed that my application got selected in the lottery system or my cheque is enchased.I have absolutely no data.

Are still there are hopes

I ma also sailing the same boat….my cheque is encashed on may 1st…but haven’t got any official receipt from USCIS. I am worried…It took 1 to 2 weeks for my frineds receipts after the cheque encashment. My employer was tellling me dat we can be +ve till we get the papers.

I got receipt # on 4th june and status is “case received and pending”..Meanwhile i applied for L1 with same employer as some urgent requirement within next month end.i wilb getting my L1 by 1st week of july.if i fly next month, i want to go for change of status in oct to H1.If any1 can help me regarding the procedure,wilb great appreciated.

U will have to be back in your country where u applied for H1. Otherwise your H1 will be treated as rejected.

RFE case:
I too received Receipt Number three weeks and now my employer says they received RFE( Request for Evidence) from USCIS. They asked for an evaluation of education and work experience in areas related to the specialty occupation for which my employer have filed petition for.
I am not sure is it normal and how much time the employer takes on average to furnish the information to the USCIS.
How much timeframe USCIS provides the employer to provide the necessary RFE.

Do anybody have any relevant information about the same.

hi deepak..first ask your consultant about crediantial assesment of ur documents.Before filln a case consultant/company makr crediantial assesment report .It is a kind of rechecn ur documents.In C.A.R USCIS govt gve us a letter,that all our documents are correct and genunine.Hope this info is useful.This procedure is done before filln H1B.If ur consultant and company already having an crediential assemnt report then there is nothn to worry.It is normal.no need to be worry…

I did asked my employer by sending them an email.. they are yet to respond.

I wonder they would have done this before filing H1B. I did submitted my documents around March 18. May be thats the reason my employer did not have time for credential assessment. Did anybody know much time the employer takes for preparing the credential assessment report.

Did the USCIS have any timeframe by which the employer should submit the credential assessment report for the RFE.

I received my petition number 2 weeks back, but my status was displayed as “Fee Payment Rejected due to Insufficient Funds and Case Placed in Suspense”. But on May 30 the status shows “Corrected fee payment received; case now pending.”. So can anybody please let me know what would be the next action?

Also i would like to know what are my chances of getting the Approval?

Transfer in US can only be done, when you have applied for your H1 when you are already in the US on an L1 visa. When you were in India while applying for the H1 visa, your interview should also be done in India only, else your Visa will be marked as rejected after October midst and that vacancy will be given to the persons in hold. My friend had the same issue, He was forced to come to India and then attend his interview. Don’t take chances, else forget your H1.

Do we still have time to get all the selected files out or they completed? IF they complete why I still didnt receive any rejection notice frm them? Please let me knw as soon as possible.

I received my EAC No. and I checked status on the web, It is showing case received and pending… When will be checking of documents start and does the EAC no given by consultant is right (It might be commonly circulated to rest of applicants ;) ) Second, wht type of cross question will be asked in the embassy round. Gernally withing a month time frame the picture gets clear. If you have not received any thing from your employer so it is clear that you rn’t selected for year 2009 Cab. Soon you ll receive back ur funds.
